Legal study on the scope of responsibilities of road managers

Decree 2017-440 published on 30 March 2017 on the safety of guided public transport systems (STPG Decree, repealing Decree 2003-425) marked the institution of a new player in the STPG process: the road manager.
According to the decree, the road manager (gestionnaire de voirie in French) is “the authority in charge of the roadway according to the French Roadway Code (Code de la voirie routière)". However, the French Highway Code does not define the notion of "road manager".

Therefore, in 2019, STRMTG called on legal expert Philippe BILLET to conduct a study to:

  • Compile an inventory of references to road management in various codes,
  • Research any related case law,
  • Analyse the current definition of road manager and its potential limitations,
  • Propose alternative definitions of road manager.
  • At the end of the study, the advantages and disadvantages of this list of alternative definitions were explained in relation to the current definition.

With a view to future changes to the decree, the report from this study will serve as a basis for discussions with the industry.
